FCC Denies Appeal Of Fine Against Nevada Licensee

The FCC has denied an appeal by ELY RADIO, LLC of an $11,000 fine for tower lighting violations at Oldies KWNA-A/WINNEMUCCA, NV. The licensee claimed that by its interpretation of its purchase agreement for the station, former licensee SHEEN BROADCASTING CO. owns the tower, but the FCC decided that the preponderance of the evidence showed that ELY owns the tower.
Also, the FCC has issued a proposed $3,000 fine against ALPHA AND OMEGA COMMUNICATIONS, LLC for change in ownership of a tower for Regional Mexican KMRI-A/WEST VALLEY CITY, UT without proper notification.
JAMES A. DAVIS has been fined $13,000 for tower lighting, cleaning, painting, and ownership change notification violations at a tower in HEARNE, TX.
And the Commission has proposed a $10,000 fine against MICHAEL GREGORY for operating an unlicensed station ("WHVY, 92.7 HEAVY FM") on 92.7 FM in MIAMI.
