Former WDJQ Hosts Settle Lawsuits; Net Show Continues

A judge has ruled that former D.A. PETERSON Top 40 WDJQ (Q92)/CANTON air personalities PAT DELUCA and CHARLOTTE DIFRANCO can continue to air their Internet show -- and that the station must pay them for unused vacation time, CANTONREP.COM reports.

Eighteen days after "The DELUCA Show" hosts DELUCA and DIFRANCO left Q92 when their contracts expired on FEB 2nd, the duo launched their same basic show on the Net. When D.A. PETERSON demanded that DELUCA and DIFRANCO stop because, in their view, the webcasts violated a noncompete clause in their contracts, the pair sued Peterson and asked STARK COUNTY Common Pleas Judge CHARLES E. BROWN JR. to rule that they could keep webcasting and that the company pay them $2,261 and $1,319 respectively for unused vacation time.

The radio station asked the judge to prohibit the webcast within a 60-mile radius of the station. BROWN denied that request, but said the duo couldn’t use or benefit from confidential information regarding Q92 sponsors.

Both sides did agree that DELUCA and DIFRANCO wouldn’t use past broadcasts of "The DeLuca Show." The station's attorney also noted that payments will be made once the station is sure that all tapes of past broadcasts have been returned.
