HOWARD STERN has lost his appeal of the dismissal of his lawsuit against SIRIUS XM RADIO over stock bonuses for subscriber growth he claimed he had generated.
THE HOLLYWOOD REPORTER reports that STERN's appeal was denied by the NEW YORK State Supreme Court Appellate Division, which agreed with the lower court's ruling in APRIL 2012 that STERN, his production company ONE TWELVE INC., and his agent, DON BUCHWALD were not entitled to bonuses based on the addition of subscribers through the merger with XM RADIO. The lawsuit had sought $300 million from SIRIUS XM.
