FCC Nixes Challenge To Bernard Ohio License Renewals, Sale Of Station

The FCC has denied PERCY SQUIRE's petition for reconsideration of the grant of license renewal applications for BERNARD OHIO Urban Inspirational WVKO-A/COLUMBUS, OH, Spanish AC WVKO-F (LA MEGA 103.1)/JOHNSTOWN, OH, Talk WASN-A/YOUNGSTOWN, OH, Oldies WGFT-A/CAMPBELL, OH, and Contemporary Christian WRBP (K-LOVE)/HUBBARD, OH and the sale of WRBP to EDUCATIONAL MEDIA FOUNDATION.
SQUIRE, the head of former licensee STOP 26 RIVERBEND LICENSES, LLC, had previously contended that BERNARD, created by lender D.B. ZWIRN AND CO. LP and owned by ROCKLYNN RADIO LLC, is actually controlled by FORTRESS INVESTMENT GROUP, which took over ZWIRN's hedge funds in 2009, and SQUIRE also raised predatory lending and racial discrimination claims.
The Commission denied SQUIRE's challenge to the renewals and sale in JANUARY, and SQUIRE appealed, asserting that the Media Bureau had "misapprehended" his arguments. In the present action, the Commission ruled that SQUIRE had not met his burden of showing errors in the original order or additional facts.
