FCC Rejects Challenge To License For Hawaii FM

The FCC has denied a Petition for Reconsideration filed by BIG D CONSULTING, INC. against the license granted by the FCC to cover the construction permit for BIG ISLAND BROADCASTING, INC. for KUHI/HAIKU, HI (since sold to HOCHMAN HAWAII FIVE, INC., now Country KRYL (Y106.5)).
BIG ISLAND won the allocation in 2004, and got its construction permit granted in 2005, and, just after commencing testing in 2008, asked the FCC for permission to take the station silent while it relocated. It signed back on in 2009. In 2008, BIG D CONSULTING filed against the license to cover, saying that the new facility precluded its own KNAN/NANAKULI, HI from upgrading and pointing to flaws in KRYL's proof of performance filing (which used a shared master antenna). The Commission accepted BIG ISLAND's engineering statement and certification, saying that the defects, even if shown, did not affect the license's grantability, and that further inquiry into a conflict in the STA request with BIG ISLAND's certifications regarding its main studio "would serve no useful purpose" now that the station has been sold.
