FCC Nixes Challenge To Buffalo-Area Noncomm FM Grant

The FCC has dismissed a challenge by the MARY V. HARRIS FOUNDATION to the grant of a new noncommercial FM at LANCASTER, NY to HOLY FAMILY COMMUNICATIONS, INC. over HARRIS' application at WILLIAMSVILLE, NY. Both communities are in the BUFFALO suburbs, and the applications were mutually exclusive.
The challenge, based on a dispute over a dispositive fair distribution preference (serving 10% of the covered population with a first or second noncommercial educational service), was "HARRIS's fourth attempt to prevail with the same argument," the Commission noted in denying the challenge.
