FCC Proposes Fine Against Unlicensed Texas Station

The FCC has proposed a $15,000 fine against WALTER OLENICK and M. RAE NADLER-OLENICK for operating an unlicensed station on 90.1 FM in AUSTIN, TX. The couple owns the building from which the alleged pirate station emanated, and a vehicle registered to Mrs. OLENICK sported a bumper sticker for "LIBERTY 90.1," the name of the station. The couple's response to the FCC's letter warning them about the operation and about their not allowing access to the station by an FCC agent "implied that they do not consider themselves subject to the laws of the UNITED STATES, because they stated they expect any future communications to come from the International Bureau only after a “treaty”'to which they are “signators” is signed.
The Commission also proposed a $9,000 fine against JCE LICENSES, LLC for EAS violations at Religion KBXD-A/DALLAS. An inspection found the station without operational EAS equipment or logs since it returned to the air in NOVEMBER 2012. The station must also submit a statement signed under penalty of perjury within 30 days confirming that it is now compliant with the EAS requirements.
