FCC Nixes Five Appeals

The FCC has denied an Application for Review filed by BLUES AND GOSPEL HERITAGE ASSOCIATION that challenged the grant of a new noncommercial educational FM station to QUITMAN COUNTY DEVELOPMENT ORGANIZATION d/b/a DEEP SOUTH DELTA FOUNDATION at CLARKSDALE, MS over the petitioner's application for a new FM at JONESTOWN, MS. BGHA alleged that QUITMAN COUNTY had failed to provide engineering and technical calculations upon which a fair distribution of service preference, which led to the grant, was based.
The Commission also denied an Application for Review filed by GENESIS COMMUNICATIONS I, INC. against the determination that neither its application in AM Auction 84 for a change of community of license for Sports WHOO-A from KISSIMMEE to WINTER PARK, FL nor the application by RAMA COMMUNICATIONS, INC. for a mutually exclusive new AM at MICANOPY, FL should receive a preference and therefore were ordered to auction. The denial was based on the determination not being a final, and therefore reviewable, order.
Also dismissed was an Application for Review filed by COVENANT NETWORK over the dismissal of its application for a new noncommercial FM at MACOMB, IL because it failed the community of license coverage rules and the rejection of attempts to amend the original application nunc pro tunc to avoid mutual exclusivity with another application.
TRINE UNIVERSITY's appeal of a $7,200 fine for public file violations at noncommercial WEAX/ANGOLA, IN was also rejected. The college's fine was reduced for a history of compliance but its contention of financial hardship was, the Commission ruled, not accompanied by adequate documentation.
And NORTHEAST HARTFORD ACORN's Application for Review of the denial of its application for a new noncommercial educational FM at WETHERSFIELD, CT and the grant of LEGION OF CHRIST COLLEGE, INC.'s application for a new FM at MANCHESTER, CT was dismissed. NHA contended that LCC did not have reasonable assurance of the availability of its transmitter site; the Commission rejected the argument because it had not been previously presented in the proceeding.
