FCC Files Brief Against Appeal Of Noncommercial Station Political Ad Ban To Supreme Court

The FCC has filed its response to MINORITY TELEVISION PROJECT's appeal to the SUPREME COURT of its challenge to the FCC's rules against political advertising on noncommercial stations, reiterating its position that the general ban on paid advertising on noncommercial stations is "necessary to preserving the noncommercial nature of public broadcasting" and that its fine against the petitioners' noncommercial KMTP-TV/SAN FRANCISCO was based on rules taking into account "a half-century of experience in both public broadcasting and commercial broadcasting" and Congress' "reasoned legislative judgment."
The FCC's brief asserts that the Ninth Circuit Court of Appeals decision "is correct and does not conflict with any decision of this court or another court of appeals" and is "a poor vehicle for the wholesale re-examination of the constitutionality of broadcast regulation that petitioner seeks" without a factual record to support MTP's contentions.
