iBquity Sues To Invalidate Patents Involved In Earlier Lawsuit

iBIQUITY DIGITAL CORP. is striking back at the company that sued it for patent infringement, filing a suit against DELAWARE RADIO TECHNOLOGIES and WYNCOMM LLC in DELAWARE District Court seeking to have the patents in question invalidated.
The new complaint, filed TUESDAY (7/1), seeks declaratory judgment that the “Side-Channel Communications in Simultaneous Voice and Data Transmission,” “Technique for Modulating Orthogonal Signals with One or More Analog or Digital Signals,” and “Voice Activated Date Range Change in Simultaneous Voice and Data Transmission” patents are not valid.
For each, iBIQUITY alleges that the processes covered by the patents were "anticipated and/or obvious over multiple prior art references that were not before the patent examiner"
In the suit, iBIQUITY notes that the defendants have brought 14 infringement complaints against broadcasters and 18 against car manufacturers, all of whom have contracts that obligate iBIQUITY to indemnify them against any losses incurred through their use of HD RADIO technology.
