MAGNUM COMMUNICATIONS has been rejected for a new 486-foot tower in the TOWN OF RUTLAND, WI for the second time in three years, reports the STOUGHTON COURIER HUB.
The company was shot down again by the DANE COUNTY Board of Supervisors in a vote last week turning down the broadcaster's request to have 15.5 acres rezoned to allow the tower for Country WBKY (BUCKY COUNTRY 95.9)/PORTAGE, WI, which is in the process of attempting to complete a move to STOUGHTON, closer to MADISON.
A previous rejection in 2011 prompted a lawsuit by MAGNUM that did not succeed, but state law changes since then prohibiting towns from rejecting new broadcast towers except on the grounds of public health and safety may affect the result of any challenges to the latest vote.
