FCC Fines Steckline For Main Studio, Public File Violations At KYUL

STECKLINE COMMUNICATIONS, INC. has been fined $20,000 for main studio and public inspection file violations at News-Talk KYUL-A/SCOTT CITY, KS. STECKLINE did not dispute the violations, which included the Commission's agent being unable to find a main studio for the station and finding that the public file located at a SCOTT CITY insurance agency had no documents after 2009, but asked for a reduction of the fine, saying that KYUL "serves a small market and would face competitive disadvantages if it is required to fully staff the Station’s main studio" due to inability to find qualified staff.
The Commission rejected the argument, noting that there are no exceptions to the main studio staffing rules without a waiver, and that STECKLINE did not request a waiver (which was denied) until JULY 26th, 2012.
The Commission also granted SAVER MEDIA, INC.'s application for modification of the facilities of KQTC/ELDORADO, TX but proposed a $10,000 fine for prematurely constructing the station pursuant to the application. DANNY RAY BOYER had previously challenged the grant of the CP to TONY CUELLAR in FM Auction 93 on the basis that CUELLAR had tried to deceive the Commission about a past felony conviction, after which CUELLAR assigned the license to SAVER (owned by CUELLAR and his wife). BOYER then objected to the modification application and that SAVER and/or CUELLAR misrepresented facts about the application. SAVER said that it built the tower to rent it out to other parties; the Commission noted that SAVER did not submit any contracts or evidence of other parties having leases for the tower.
