BROADCASTING AND CABLE MAGAZINE reports that the Third Circuit Court of Appeals has rejected the FCC's proposal to have the court expedite the CBS SUPER BOWL/JANET JACKSON indecency ruling challenge. The FCC proposed setting SEPTEMBER 11 as the date for opening briefs to be files, but the magazine says that a court document it has obtained shows a due date of SEPTEMBER 27 for the first briefs, which would set oral arguments for late NOVEMBER or DECEMBER rather than early NOVEMBER, as the FCC's timetable would have set.
