Photographer Sues Radio, TV Stations, Websites For Using Photo Without Proper Attribution

A photographer is suing two radio stations. a television station, and others for using one of his photos, posted to Wikimedia under a Creative Commons license, on their website without proper attribution.
LARRY G. PHILPOT is suing CURTIS MEDIA GROUP Country WQDR/RALEIGH-DURHAM, TOLEDO RADIO Country WPFX (107.7 THE WOLF)/LUCKEY-TOLEDO, OH, DOT COM PLUS, LLC Triple A WZEW (92ZEW, misidentified as "WDEX")/MOBILE, EAGLE COMMUNICATIONS/HAYS, KS, GRAY TELEVISION NBC and CBS affiliate KALB-TV (NEWSCHANNEL 5 and CBS 2)/ALEXANDRIA, LA, and RURAL MEDIA GROUP (MYRURALTV.COM) for using a 2009 photo of WILLIE NELSON in concert in ST. LOUIS that was posted to Wikimedia with the Creative Commons Attribution 2.0 Generic license, which requires attribution as "Photo by LARRY PHILPOT, www.soundstagephotography.com."
The suits claim that the websites stripped metadata from the photos and lacked proper attribution, and are asking for $150,000 per infringing use and an additional $25,000 for violation of the Digital Millenium Copyright Act by stripping the metadata.
PHILPOT has also sued THECELEBRITYCAFE.COM for a similar alleged violation with a KID ROCK photo.
