American Tower Sues Urban Radio Broadcasting For Unpaid Rent

AMERICAN TOWER, L.P. has filed suit against URBAN RADIO BROADCASTING, LLC and affiliated companies for past due and future rent at a tower in WEST POINT, MS for the antenna of Urban WACR/COLUMBUS AFB, MS.
The suit, filed in U.S. District Court for the Southern District of MISSISSIPPI, JACKSON Division, alleges that AMERICA TOWER leased space to URBAN's predecessor as licensee, CAPSTAR/iHEARTMEDIA, in 2004, and the lease was assigned to URBAN in 2005 when the station was sold. AMERICAN TOWER says in the suit that URBAN has "failed and refused to pay all rent when due" to the tune of $90,413.10 as of JUNE 2015, and that URBAN has failed to cure the defect despite notice in 2010 and 2014.
The plaintiff is also exercising a clause in the lease to terminate the agreement, evict URBAN, and accelerate payments of more than $170,867.89.
