A preliminary court hearing TODAY (11/30) in LOS ANGELES COUNTY Superior Court will address the issue of VIACOM and CBS CORP. Chairman SUMNER REDSTONE's mental competency.
THE HOLLYWOOD REPORTER reports that the 92-year billionaire's care is the subject of a lawsuit by ex-girlfriend MANUELA HERZER, who is suing after being removed as REDSTONE's legal agent in favor of VIACOM CEO PHILIPPE DAUMAN. REDSTONE broke up with HERZER and his other girlfriend SYDNEY HOLLAND earlier this year.
In the suit, filed WEDNESDAY (11/25), HERZER alleged that REDSTONE's move to oust her as his agent was invalid because he "lacked the mental capacity" to make that decision, with evidence including the OCTOBER 16th Advanced Care Directive, signed with an illegible mark that cascades from the signature line down to the bottom of the page.
The suit calls REDSTONE "Vacant, expressionless and out of touch" and "a living ghost," obsessed with eating steak and having sex, among other descriptions. But DAUMAN, in a declaration filed in the case, called REDSTONE "engaged and attentive" in a NOVEMBER 3rd visit and his doctor said REDSTONE's speech is impaired but his brain scan in recent weeks was "quite good for a 92-year-old."
