FCC Nixes Appeal Of Expiration Of Las Vegas AM Permit

The FCC has rejected an appeal, styled as a "civil rights" case, by POWELL MEREDITH COMMUNICATIONS COMPANY of the denial of reconsideration of the denial of its request to toll the construction permit for a new AM at PARADISE (LAS VEGAS), NV.
The permit was initially tolled while the grant was subject to litigation by ALVIN LOU MEDIA, but the tolling was ended when ALM exhausted its judicial appeals and the Media Bureau dismissed its petition for reconsideration of the PARADISE permit. A tolling extension was granted to push the deadline to SEPTEMBER 8, 2014, but a second tolling extension request was denied.
The Commission said that PMCC's "allegation boils down to the assertion that because PMCC’s principal, AMY MEREDITH, is a woman, and PMCC did not prevail in its second tolling request and in certain other applications before the Commission, specifically the Bureau’s Audio Division, PMCC must therefore be the victim of discrimination." PMCC also connected the PARADISE case to another case in which it claimed five of eight FM translator applications it made were fraudulently transferred to a third party due to "hacking" of the FCC's CORES and CDBS systems, with MEREDITH asserting that the hackers claimed to have a business arrangement with MEREDITH's ex-husband; the Commission said that PMCC had not shown adequate connection between the cases and merely stated that the hackers might interfere with the PARADISE application and not that they actually did so.
New Jersey Translator Permit Reinstated
The Commission also granted ED SCHOBER's appeal of the rescinding of his permit for a new FM translator in MANAHAWKIN, NJ. SCHOBER had admitted that he had not had agreement with a tower owner when he specified a site for the translator in his application but said that he had "reasonable assurance" space was available on the tower and other sites nearby; the Commission cited a previous ruling (issued after the initial denial) that allowed for liberal use of corrective site designations to cure the defect of lack of reasonable assurance of site availabilities.

And the Commission denied the appeal of US PRO DESCUBIERTA of the dismissal of its application for a new LPFM at SEFFNER, FL due to spacing violations and impermissible change of over 50% of the applicant's board of directors after initially naming of FRANK GREER as a board member while he was also listed on two other LPFM applications.
