Photographer Sues Cumulus Over Use Of Photo On WABC/New York Website

Photographer RICHARD HARBUS has sued CUMULUS MEDIA in U.S. District Court for the Southern District of NEW YORK alleging that News-Talk WABC-A/NEW YORK's website infringed his copyright on a photo of NEW YORK KNICKS' then-coach DEREK FISHER.

The alleged infringement came in FEBRUARY after FISHER was fired by the KNICKS; the photo had been licensed to the NEW YORK DAILY NEWS and CUMULUS allegedly posted the same photo without license or credit alongside an article about KURT RAMBIS' hiring as interim coach.

HARBUS is asking for statutory damages of $150,000 and attorney's fees and costs or alternative statutory damages of $2,500 per violation up to $25,000.
