NY State Supreme Court Judge Denies Entercom Motion To Dismiss Payola Suit

ENTERCOM COMMUNICATIONS has reacted to NEW YORK STATE SUPREME COURT Judge IRA GAMMERMAN's decision to dismiss ENTERCOM's request for a dismissal of NY STATE Attorney General ELIOT SPITZER's Payola Suit against the broadcast company (NET NEWS 3/8). That ruling allows SPITZER's case against ENTERCOM and six other broadcast companies to move forward.
An ENTERCOM spokesman told ALL ACCESS, "While we are disappointed by the court's decision to permit this case to proceed beyond this early stage, we continue to believe that the evidence will show that the Attorney General's case is without merit. This ruling was not an assessment of the merits of the case, but rather of whether the allegations were sufficient to avoid dismissal at the outset of the case. ENTERCOM continues to comply with federal sponsor identification rules, and we continue to enforce our policies prohibiting payola."
