The FCC has rejected a challenge by groups calling themselves the RIGHT TO DECENCY, INC. and AMERICAN DECENCY ASSOCIATION to the Consent Decrees allowing VIACOM (now CBS RADIO) to settle then-outstanding indecency claims for a $3.5 million voluntary payment to the Commission and by anti-MANCOW gadfly DAVID SMITH, the ILLINOIS FAMILY INSTITUTE, the CONCERNED WOMEN FOR AMERICA (ILLINOIS chapter), and JULIE CORDRY challenging EMMIS' similar Consent Decree for $300,000. In each case, the FCC asserts that it had the power to make the deals and had considered all previous violations in doing so.
