The wave of photographer lawsuits against radio companies for unlicensed use of copyrighted photos without permission has reached north to CANADA.
FAMEFLYNET, INC., plaintiff in several of the suits, has filed suit against EVANOV RADIO GROUP for using three photos of SHIA LABEOUF and his then-fianceé, now-wife MIA GOTH on the website of Top 40/Rhythmic CIDC (Z103.5)/ORANGEVILLE-TORONTO. The suit alleges that Z103.5 personality KAT CALLAGHAN posted the photo to the website and that the station's coverage of part of Western NEW YORK State brings the case under jurisdiction of U.S. District Court; FAMEFLYNET is seeking statutory damages of up to $150,000 per infringement or actual damages and disgorgement of profits, plus a permanent injunction, costs, and attorney's fees.
