Turtles/Flo & Eddie Settle California Pre-1972 Royalty Suit Against SiriusXM

One Case Settled

THE TURTLES -- MARK VOLMAN and HOWARD KAYLAN -- have settled their CALIFORNIA royalty suit against SIRIUSXM just before the case was to go to trial.

The case, in which VOLMAN and KAYLAN's claim for royalties for pre-1972 recordings led to summary judgement for the plaintiffs in 2014 followed by a partial summary judgement this SEPTEMBER eliminating punitive damages and unfair competition claims, was in the damages phase when the settlement was reached. 

The deal will have to be approved by U.S. District Court Judge PHILIP GUTIERREZ, and a joint motion for preliminary approval will be filed on DECEMBER 5th.  Two other cases over the pre-1972 royalty rights remain active, with SIRIUSXM appealing a TURTLES victory in NEW YORK and an appeal of SIRIUSXM's win in FLORIDA is also pending.
