Former Morning Host Mo Loses Lawsuit Against WDJQ (Q92)/Canton

The CANTON REPOSITORY reports that former PETERSON Top 40 WDJQ (Q92)/CANTON morning host BRYAN "MO" MODZELEWSKI has lost his suit in STARK COUNTY Court of Common Pleas alleging breach of contract for being fired without cause and without notice or pay in FEBRUARY 2016. The station counterclaimed, alleging that MODZELEWSKI was fired for a 38-minute rant on the air criticizing the station and failing to play music, news, or spots. Magistrate KRISTEN S. MOORE ruled last week in favor of the station after a non-jury trial in JANUARY.
"Mr. MODZELEWSKI's lawsuit against the Q92 team directly challenged one of the most fundamental principles recognized in the workplace: that an employee is obligated to competently perform his or her job, rather than advancing his or own personal agenda at the expense of the employer and fellow employees," station attorney EDMOND MACK told the REPOSITORY in a statement on the case. "Magistrate KRISTEN MOORE's decision confirms this workplace principle, and once again makes clear that an employee's disloyalty toward his or her employer and coworkers will not be tolerated in our community."
Station GM DON PETERSON II added, "We are a team at Q92, and we work for our listeners. We are glad this case is coming to an end, and that our team can continue to focus on serving our community, our listeners and our advertisers."
