FCC Nixes Challenge To Grant Of New Florida Noncommercial FM Permit

The FCC has dismissed and denied FLORIDA COMMUNITY RADIO, INC.'s Application for Review of the grant of a new noncommercial educational FM station at OTTER CREEK, FL to CITRUS COUNTY ASSOCIATION FOR RETARDED CITIZENS, INC.

FCR was the initial tentative winner of a mutually-exclusive application face-off with CCARC for the vacant channel, but the FCC granted CCARC's Petition to Deny based on FCR's alleged failure to document its eligibility for points for which it was credited; FCR had also contended that CCARC should not have gotten points for best technical proposal due to an reparative amendment that downgraded its coverage, an argument repeated in the Application for Review.
