Bubba The Love Sponge Files Amended Counterclaim Against Nielsen

BUBBA THE LOVE SPONGE's attorneys have filed his counterclaim against NIELSEN AUDIO after Judge JAMES D, WHITTEMORE approved an order permitting the amended filing.
BUBBA CLEM's previous attempt to file a counterclaim and third-party complaint had been rejected, but the judge ruled that BUBBA had shown good cause for the delayed counterclaim filing, including the slow discovery process and "voluminous" document dump -- 80,000 pages, mostly marked "Confidential" or "Confidential - Attorney's Eyes Only" -- as well as NIELSEN's demands that some information be redacted and the late maturation of the counterclaim (with BEASLEY's termination of its contract with NIELSEN in DECEMBER 2016).
NIELSEN's contention that the counterclaim should have also included COX MEDIA GROUP as a co-defendant was also rejected by the Judge as unnecessary, and the Judge dismissed NIELSEN's concern that the counterclaim might cause significant delay in the proceedings, noting that the counterclaims may be compulsory since the claims of both NIELSEN and BUBBA arise from the same basis, the alleged ratings tampering.
The 18 page counterclaim includes the allegations that NIELSEN and COX, owner of BUBBA's former station Talk WHPT (102.5 THE BONE)/TAMPA, conspired to interfere with BUBBA's employment by crosstown BEASLEY Rock WBRN and his advertisers; that NIELSEN de-installed PPM panelists shown to listen to BUBBA; and that COX and NIELSEN conspired in a "sting operation" using an individual named NICHOLAS TABACHUK to gather "evidence" against BUBBA, leading to WBRN's delisting and BUBBA's ultimate dismissal.
A NIELSEN Spokesperson told ALL ACCESS, "These latest claims are entirely without merit and NIELSEN intends to vigorously defend against them."
