FCC Grants KSDS/San Diego Power Boost

The FCC has conditionally granted SAN DIEGO COMMUNITY COLLEGE DISTRICT noncommercial Jazz KSDS (JAZZ 88)/SAN DIEGO's application to increase to 22 kw, over objections from crosstown ENTRAVISION/BAY CITY TV FOX affiliate XETV (TV) (FOX 6).
KSDS had applied for the increase a decade ago, but its location at 88.3 FM gave rise to interference complaints from XETV, which is on channel 6. After a long process that dealt with whether XETV had standing to complain (it is licensed to TIJUANA and is not technically protected by FCC channel 6-FM interference rules, but claimed various other reasons, including NAFTA, as bases for its complaints), the Commission ruled that KSDS can use 22 kw but vertically polarized only, and the station must take "reasonable steps to help viewers mitigate Channel 6 interference" and must protect the headends of local cable companies from the interference, although the cable companies are ultimately responsible for eliminating any interference.
