New Hampshire Public Radio, Magazine Publisher Settle Suit Over 'Outside/In,' 'Outside' Podcast Names

CURRENT.ORG reports that NEW HAMPSHIRE PUBLIC RADIO has dropped its lawsuit against OUTSIDE magazine publisher MARIAH MEDIA NETWORK over the trademark "OUTSIDE/IN" for a podcast and has reached a settlement of the dispute.
The suit, filed in U.S. District Court for the District of NEW HAMPSHIRE, was filed in response to cease-and-desist letters from MARIAH claiming infringement of its mark for its "OUTSIDE" podcast and "OUTSIDE RADIO NETWORK" 1998-99 syndicated radio show; NHPR sought declaratory relief under the LANHAM Act to establish that MARIAH's trademark of the name "OUTSIDE" did not cover podcasts.
The settlement, a trademark coexistence agreement, allows NHPR to keep the name "OUTSIDE/IN" for its podcast, NHPR President BETSY GARDELLA told CURRENT.
