Report: Victory Sues Virgin, EMI Over Hawthorne Heights

VICTORY RECORDS filed suit on THURSDAY (11/2) against VIRGIN RECORDS and EMI MUSIC for allegedly trying to poach recording act HAWTHORNE HEIGHTS from its roster, according to the HOLLYWOOD REPORTER. VICTORY is reportedly seeking a minimum of $10 million in compensatory damages and $10 million in punitive damages.
The latest suit alleges that VIRGIN's JASON FLOM and head of business affairs JASON KEMPLER persuaded the band to declare itself free of contract with VICTORY. VICTORY apparently learned on SEPTEMBER 7 that HAWTHORNE HEIGHTS signed with VIRGIN but maintains that the recent dismissal of several counts in the band's own suit against VICTORY over its contract means the contract is still in effect.
An EMI representative told the HOLLYWOOD REPORTER that the company had not seen the suit and would not comment.
