The FCC has, at least for now, reinstated CORTARO BROADCASTING CORP.'s license for KCKY-A/COOLIDGE, AZ, which was revoked and deleted under the Commission's "red light" rules for failure to pay fees owed to the FCC.
The Commission rejected CORTARO's arguments in its Petition for Reconsideration that the dismissal of its renewal application requires notice and a hearing, and also rejected an argument that the Commission staff should have taken public service and financial difficulties into account. However, the Media Bureau agreed that since the Petition was filed in a timely manner and the filing of a renewal application constitutes a continuance of the license that remains in effect through any hearing and final decision, the license had been prematurely revoked, although the Commission is concurrently instituting a proceeding with an Order to Pay or Show Cause to formally revoke the license under the "red light" rules.
CORTARO owes the Commission regulatory fees for fiscal years 2008, and 2011-2015.
