The regionally-syndicated KENTUCKY SPORTS RADIO, host MATT JONES, and KSR website contributor DREW FRANKLIN have asked a NEBRASKA U.S. District Court judge to dismiss or move the venue of a lawsuit against them by a prominent college basketball referee, his wife, and his company.
JOHN HIGGINS, his wife CAROL, and their WEATHERGUARD, INC. (a/k/a ROOFEREES.COM) sued KSR, JONES, and FRANKLIN for allegedly prompting UNIVERSITY OF KENTUCKY basketball fans to post negative reviews of the referee's roofing business and make harassing calls after KENTUCKY's loss to NORTH CAROLINA in last year's Elite Eight quarterfinal and coach JOHN CALIPARI's criticism of the refereeing.
The defendants asked the judge to dismiss the case or, in the alternative, allow a change of venue to KENTUCKY, contending that NEBRASKA has no jurisdiction over the defendants, whose operation, the motion said, "are aimed at UNIVERSITY OF KENTUCKY sports fans in the state of KENTUCKY" and were discussing HIGGINS' actions as a referee in MEMPHIS.
