Judge In Hawthorne Heights-Victory Case Clarifies Ruling

Last month Judge MILTON SHADUR of the U.S. District Court, Northern District of ILLINOIS, issued an order stating that HAWTHORNE HEIGHTS' copyright, trademark, and declaratory relief claims against VICTORY RECORDS were dismissed (NET NEWS 10/20).

Now the judge has clarified that he was only dismissing the claims to the extent that they relied on a theory that HAWTHORNE HEIGHTS could terminate VICTORY's rights "at will." The court confirmed that those claims remain in the case based on the band's terminating VICTORY's rights "for cause."
