FCC Rejects Another Appeal By Roy Henderson Of License Cancellation For KROY/Palacios, TX

ROY E. HENDERSON has lost another appeal of the FCC's JANUARY 11th decision dismissing the renewal application of his KROY/PALACIOS, TX and deleting the license. HENDERSON appealed with an Application for Review a previous ruling cancelling the license for operating at an unlicensed site after two STAs for an alternate site expired and/or being silent for at least one consecutive 12-month period during 2009-14.
This time around, HENDERSON claimed that the FCC's action was inconsistent with prior treatment of late license renewal application filings, and exhibited bias and violated ex parte rules. The Commission said that it only uses its discretion to reinstate an expired license when compelling circumstances beyond the licensee's control are involved rather than an alleged mistake by an engineer; that the public interest would not be served by allowing a station that has failed to serve its community to retain its license; and that HENDERSON failed to show bias on the Media Bureau staff's part.
