The FCC has dismissed IVAN ANGELES' Petition for Reconsideration and upheld its $15,000 fine against him for operating an unauthorized radio station in PASSAIC, NJ.
ANGELES was hit with a Notice of Apparent Liability on SEPTEMBER 15th, 2015 for operating the pirate station, and the Commission says it sent notice to an address in GARFIELD, NJ where ANGELES had previously received notices and returned proof of delivery, but, this time, ANGELES did not respond. He was fined on MAY 16th, 2016; on JULY 13th, 2016,ANGELES' attorney contended that ANGELES never received the notice, but the Commission said that the response was late and the FCC is statutorily barred from accepting the petition, although it added that it would have denied the petition if it had been timely filed because ANGELES failed to respond to or deny the facts in the NAL in his petition.
