The station's construction was dependent on a channel change for his KJNY/FERNDALE, CA, which was in turn dependent on a channel change for KMMI/LOLETA, CA, and MCCUTCHEN claimed that KMMI was no longer willing to commit to reimburse him for his expenses in his own channel change. The Commission said that it would not have granted the original tolling had it been aware that MCCUTCHEN owns both KXGO and KJNY.
