Appeals Court Upholds FCC Repeal Of Net Neutrality Laws, But Strikes Down Block Against States Making Their Own Rules

The FCC's repeal of net neutrality laws has been upheld by a three-judge panel of the U.S. Court of Appeals for the D.C. Circuit, but struck down the Commission's attempt to block states from passing their own net neutrality rules.
The ruling on TUESDAY (10/1) upheld the 2017 Restoring Internet Freedom order repealing the net neutrality rules with two exceptions, one the preemption of state regulation and the other remanding the order to consider issues of public safety, regulation of pole attachments, and the impact on the lifeline program.
The split decision for the Commission in MOZILLA CORPORATION v. FCC follows last week's loss on the ownership rule revisions issue in the Third Circuit Court of Appeals.
