FCC, NAB Lose Bid For Third Circuit En Banc Hearing Of Appeal Of Court's Rejection Of Ownership Rule Changes

The FCC has lost its bid to have the full THIRD CIRCUIT COURT OF APPEALS hear its appeal of the ruling by a three-judge panel that vacated and remanded its 2017 broadcast ownership rule changes loosening cross-ownership and duopoly prohibitions.
Petitions by the Commission and by a group of broadcast interests led by the NAB for an en banc hearing before the entire court were dismissed TODAY in a terse one-sentence decision signed by Judge THOMAS L. AMBRO, leaving the Commission and the NAB with only a SUPREME COURT review as an option for appeal.
The case is PROMETHEUS RADIO PROJECT, et al., vs. FEDERAL COMMUNICATIONS COMMISSION.
