EMI GROUP and BERTELSMANN AG have jointly announced a settlement of litigation concerning the original, unlicensed NAPSTER system. EMI and other labels alleged that BERTELSMANN was liable for copyright infringement because it invested in NAPSTER, a company that at the time was openly allowing copyright infringement.
The settlement covers the resolution of the legal claims of EMI companies. BERTELSMANN admits no liability in making this settlement.
"We are pleased to have reached this agreement with BERTELSMANN," said EMI GROUP CEO ERIC NICOLI. "We can now put this matter behind us and continue to pursue the development of new legitimate digital music business models."
