FCC Rejects Bid To Block Michigan Combo Sale

The FCC has denied HEARTLAND COMMUNICATIONS' petition to deny the sale of Oldies WHRY-A/HURLEY, MI and Hot AC WUPM/IRONWOOD, MI to GERALD J. HACKMAN and JOHN J. NIX by CHARLES H. GERVASIO's BIG G LITTLE O INC. in a stock purchase agreement for $10.833/share ($1.25 million aggregate). 

HEARTLAND alleged that the deal violates a four-year noncomete agreement signed by HACKMAN in 2004, but the Commission noted that it does not get involved in private contractural disputes and, absent a court injunction or stay, the noncompete matter is outside the Commission's jurisdiction.
