Steve & Vicki TV Spots For B98.5 Draw C&D From Star 94

Attorneys for LINCOLN FINANCIAL Top 40/Mainstream WSTR (STAR 93)/ATLANTA have sent a cease-and-desist order to crosstown COX AC WSB (B98.5), for airing TV spots that featured former STAR 94 morning duo STEVE MCCOY AND VIKKI LOCKE, who are touting their upcoming morning gig on B98.5, starting JULY 1st. The ATLANTA JOURNAL-CONSTITUTION reports that the order asserts that the pair violated a non-compete clause in their Star 94 contracts by appearing in the TV spots. Although MCCOY or LOCKE don't identify themselves in the TV spots, a voiceover and text do mention them.
However, the non-compete clause cited in the C&D orders that the duo cannot appear on any Atlanta radio station, website, cable television "or other wired service delivered to subscribers." There is no specific mention of appearing on commercial broadcast television.
Nevertheless, WSTR GM MARK KANOV declared the TV spots were a violation of their contracts. WSB-F GM DAVID MESZAROS responded by noting that STEVE & VICKI's STAR 94 contracts "were thoroughly examined prior to the filming and airing of the current TV spots," which cleared them of any culpability, so the spots will continue to air.
