A judge has thrown out a lawsuit against CLEAR CHANNEL AC WLTW (106.7 LITE FM)/NEW YORK that alleged violation of telemarketing laws. U.S. District Judge HAROLD BAER JR. dismissed the case filed by NEW YORK resident MARK LEYSE as a class action; LEYSE had claimed that the station made unsolicited automated calls to area residences promoting the station without prior consent, but the judge ruled that FCC law exempts messages by radio and TV broadcasters promoting a broadcast.
