FIRST MEDIA RADIO Country WDWG (BIG DAWG 98.5)/ROCKY MOUNT, NC has lost its appeal of a small-claims court suit by a listener who won a singing contest and had to go to court to get her $500 prize.
The ROCKY MOUNT TELEGRAM reports that LIZBETH HOLT of NEW BERN was the winner of the local qualifying heat of the national COLGATE COUNTRY SHOWDOWN competition on SEPTEMBER 6, promoted by the station, but that a station employee mistakenly identified another contestant as the winner and the sponsor, THOMAS DRUG STORE, paid the prize to that contestant. HOLT was later told that she'd won the contest but the station would not pay the prize because it said it was not the party awarding prizes in the original contest, and that the burden was on the other contestant to return the money. After HOLT won in small-claims court, the station hired an attorney to appeal the $500 judgement but lost.
