"Billable Hours" will be heard a few times in the near future, as Consultant and PPM Watchdog RANDY KABRICH's lawyers have responded to a letter from ARBITRON demanding the returns of PPM equipment that KABRICH purchased on eBAY, and subsequently cracked open to see how it worked.
KABRICH had heard MONDAY (NET NEWS 8/11) from ARBITRON's Associate General Counsel & Chief Intellectual Property Officer JAMES DERRY in the form of a letter saying, "You are not an authorized user in any manner whatsoever of any ARBITRON equipment. As such, we must insist that you return any and all ARBITRON equipment that you have possession or control over, including but not limited to ARBITRON’s PPM’s. ARBITRON must also insist that you immediately cease and desist any and all activities to reverse engineer, decompile, test, disassemble or any other activities related to any ARBITRON equipment."
TODAY (8/14), KABRICH's legal beagles have fired back, with GREGORY A. HEARING of the law firm THOMPSON, SIZEMORE, GONZALEZ & HEARING writing, "We are investigating your letter's assertions and reviewing applicable law including ICC Rules and Regulations regarding freight salvage. Mr. KABRICH asserts that the PERSONAL PEOPLE METER (PPM) devices were lost in freight and that he is the lawful owner of them."
