The FCC has rejected STEVEN WENDELL's petition for reconsideration of the end of tolling of the construction permit for unbuilt WXNH(AM), JAFFREY, NH. The Commission terminated its tolling of the permit when the licensee of WLIE-A/ISLIP, NY opposed the tolling and noted that the delay was based on litigation concerning an alternative, as-yet-unauthorized site being proposed by WENDELL rather than problems with the site specified in the permit.
In another Commission decision, FARM AND HOME BROADCASTING COMPANY's sale of WFRM-A/COUDERSPORT, NY to L-COM, INC. has been granted over the objecion of GERALDINE R. MILLER, who claimed that FARM AND HOME President CARY H. SIMPSON breached his fiduciary duty to shareholders by selling the station without prior approval of the board of directors. The Commission noted that the issues are a "private controversy" that belongs in local court rather than before the FCC.
