DESTINY MEDIA TECHNOLOGIES HAS filed a statement of defense and counterclaim against YANGAROO in the U.S. patent infringement lawsuit brought by YANGAROO. Describing the lawsuits allegations as "without merit, DESTINY "oppose it vigorously."
DESTINY further terms YANGAROO's press releases about winning "an "injunction case" as exaggerated and misleading. "The case has just begun and there is no motion for a preliminary injunction before the court," the statement read.
DESTINY claims that its system "simply does not operate the same way that YANGAROO's patent claims call for and that DESTINY's technology dates back to well over a year prior to their patent filing dates." DESTINY also believes that bringing this case is highly improper as the relevant What's more, its computer systems reside outside the U.S. and it's alleged that YANGAROO brought this case "as a result of the related Canadian litigation."
If DESTINY prevails, it will seek its costs in this litigation from YANGAROO.
