FCC Cancels EAS Fine Against KWVE

The FCC has canceled a proposed $5,000 fine on CALVARY CHAPEL OF COSTA MESA, INC. for sending out its own commercial programming and an ad as part of an EAS test message originating from its Contemporary Christian KWVE/SAN CLEMENTE, CA (ORANGE COUNTY), but has issued an admonishment for the mistake.
The station admitted that an employee ran the wrong message when attempting to send out a scheduled weekly test, instead running an unscheduled Required Monthly Test but failing to send the End of Message code. The Commission reversed the fine on its own motion and said, "while we seek strict compliance in the EAS arena given the national interests at stake, and while no one factor standing alone would justify modification of the proposed NAL, we conclude after further consideration of the totality of the evidence that a different approach is warranted in this limited instance."
