Lawyers for CLEAR CHANNEL have sent the folks at COX a letter, dated MARCH 3rd, regarding an agreement that BUBBA "THE LOVE SPONGE" CLEM had signed on his way out the door at CLEAR CHANNEL WXTB (ROCK 98)/TAMPA. a couple years back. The purpose of the letter is to limit what BUBBA can or may say on his scheduled appearance on crosstown Alternative WSUN (97X)/TAMPA on THURSDAY (3/9) at 7a on THE MORNING X with FISHER & BOY.
The letter to COX reads: "As MR. CLEM is fully aware, MR. CLEM is currently bound by a non-disparagement clause in the Agreement that prohibits him from disparaging CLEAR CHANNEL or its personnel, including management. Morever, MR. CLEM is further bound by the confidentiality restrictions in the Agreement, which similarly remain in force.
"Please be advised that any violation by MR. CLEM of the non-disparagement clause or the confidentiality restrictions will be taken seriously and CLEAR CHANNEL will enforce its rights to the full extent of the law." CC lawyers invited COX to review the agreement, which they say can be provided by BUBBA.
COX lawyers, specifically STEPHEN O. COLE, fires back: "Should CLEAR CHANNEL desire that my client review any documents, then they should be provided to me. Be advised that any materials which you do furnish to me are not privileged and will not be regarded as confidential. To the contrary, any such materials, may at the election of my client, be provided to the public."
Needless to say tape will be rolling, and many ears will be listening to what could be some very juicy radio.
