FCC Fines Translator Operator, Dismisses Trio Of AM Applications

LANE COUNTY SCHOOL DISTRICT has been fined $500 by the FCC for a late license renewal application and unauthorized operation of FM translator K2121BP/FLORENCE, OR. The licensee told the Commission it inadvertently failed to file the application with the renewal application for its KRVM/EUGENE.
In addition, the Commission dismissed Applications for Review by two companies owned by DAVE GAREY for new AMs at LARGA VISTA, TX, PASS CHRISTIAN, MS, and WINOOSKI, VT. FIRESIDE MEDIA (at LARGA VISTA and PASS CHRISTIAN) and JET FUEL (at WINOOSKI) ended up with "singleton" applications after AM auction 84, meaning that they became unopposed and not mutually exclusive with any other applications.
The companies failed to timely file Form 301 applications within 60 days of notification. GAREY contended that he should not have to file the Form 301 applications until removal by the FCC of what he called "irreparable federal debtor status," based on penalties imposed when he withdrew applications in FM Auction 37. The Commisison forgave his $108,892 in penalties and refunded half of his Auction 37 upfront payment, but GAREY still failed to file the forms on time.
