The FCC has proposed a $12,000 fine against POWER MINISTRIES for failure to operate an FCC-certified transmitter at low power AC FM WRLE-LP/DUNNELLON, FL. The action follows an interference complaint by the FAA's JACKSONVILLE center. When an agent asked that the transmitter be turned off, the station representative on duty refused; upon phone contact with the station owner, the owner also refused unless his engineer was present. Finally, once the agents inspected the station, they saw that the transmitter was not FCC-certified and that interference ended when the transmitter was shut off.
The fine was revised upward from the $7,000 base because the violation was, according to the Commission, "particularly egregious" and threatened lives while the owner and representative refused to immediately comply with FCC orders.
