Motor Racing Network Wins Jury Verdict Against New Hampshire Track

MOTOR RACING NETWORK has won a $993,724 jury verdict against NEW HAMPSHIRE MOTOR SPEEDWAY for breach of contract. The MANCHESTER UNION LEADER reports that the jury agreed with the radio network that the race track failed to give the contractually-required three years' notice before terminating the radio rights contract, which it inherited from a previous track owner and which it claimed was not a valid contract, to switch to parent SPEEDWAY MOTORSPORTS' own PERFORMANCE RACING NETWORK.
The track initially sued the radio company to end the contract, drawing a countersuit. Judge RICHARD B. MCNAMARA previously ruled that the contract was not enforceable, but allowed the trial to proceed to determine whether the speedway had made a promise to the network and caused the network to incur damages based on breaking that promise.
Track EVP/GM JERRY GAPPENS told the UNION LEADER that his company is "reviewing the options and will appeal the verdict."
