FCC Nixes Magic 95.9/Baltimore Power Increase

The FCC has denied RADIO ONE's attempt to upgrade its Urban AC WWIN-F (MAGIC 95.9)/GLEN BURNIE-BALTIMORE by changing its community of license to ARBUTUS, MD and increasing power from 3,000 to 6,000 watts from the same tower site.
RADIO ONE had argued that the only additional interference that would require a waiver would be to first-adjacent-channel CUMULUS Classic Hits WSOX/YORK, PA and that it had gotten CUMULUS' consent to the change. CBS RADIO's Top 40/Rhythmic WPGC/MORNINGSIDE, MD-WASHINGTON, HOWARD UNIVERSITY Urban AC WHUR/WASHINGTON, and PRETTYMAN BROADCASTING CO. Oldies WICL (OLDIES 95.9)/WILLIAMSPORT, MD-HAGERSTOWN-MARTINSBURG objected due to interference to their signals.
RADIO ONE also argued that interference to those stations was permissible due to grandfathering of pre-1964 shortspacing, but the Commission noted that changes can only be made if they do not increase those interference areas and populations.
